TERMS AND CONDITIONS OF THE CAMPAIGN

"LaLiga Africa MVP – End of the season"

This document of terms and conditions ("Terms and Conditions") ─ consisting of a set of (a) "Particular Conditions" and (b) "General Conditions" ─ sets out the rules governing your participation in the Campaign.

Please read this document carefully before participating. Your participation in the Campaign implies that you accept and agree to comply with the Terms and Conditions in its entirety.

Which are the dates for participation?	18^th May, 2023 from 0:00 GMT+2 until 28^th May, 2023 until 23:59 GMT+2).
What do I have to do to participate?	Enter in the website of the campaign, participate in the poll available therein by providing your MVP vote and fulfill your personal data requested in the form.
Is there a limit to the number of participations per person?	One participation per person and email address only.
Which is the prize to be awarded?	two type of prizes will be awarded: A trip to Spain for one person that will include accommodation, flight tickets and a ticket for a LaLiga Santander match as detailed below. In addition, there is also a chance to get one LaLiga Puma ball if you share the poll through your Twitter or Whatsapp account by sharing the link available within the website of the campaign. Details of the trip to Spain: Trip to Madrid, Spain for one (1) person which will include two (2) nights at a 3 stars hotel in a single bedroom room with a set breakfast, lunch and dinner included. Dates will be set between September and November 2023. The flight will be arranged between the capital of the winner’s country of residence and Madrid’s airport. It will also include transfers from the Madrid’s airport to the hotel and back, plus from the hotel to the stadium and back. The trip is subject of cancelation if the winner is not eligible to obtain a Schengen visa. For clarification purposes it will be the winner´s sole responsibility to obtain the relevant visas and have the documentation required by the authorities in place to travel to Spain. LaLiga will not assume any responsibility nor any costs in this regard. The Prize does not include expenses different from those indicated such as diets, food, drinks, accommodation extras, insurance or transport different from the ones indicated above.
How many winners will be selected?	One (1) winner for the trip to Spain, and ten (10) winners for the LaLiga Puma balls.
When and how will the winner be selected?	Winners will be selected between the 29th and the 31st of May, 2023. They will be chosen randomly.
How will the winner be notified?	Winners will be notified by email to the email address provided in the online form when registering in the campaign.
How will the prize be delivered to the winner?	For the trip winner, the details of the prize will be sent by email. For the balls’ winners, their gift will be sent to the physical address provided by the winner via email.

GENERAL CONDITIONS

Organiser:
1. LALIGA GROUP INTERNATIONAL, S.L. ("LaLiga"), with NIF number B- B05421805 and address at Calle Torrelaguna 60, 28043, Madrid, is the organizer and promoter of the Campaign.
Purpose:
1. Through this promotional campaign (the "Campaign") we aim to promote LaLiga products and/or services by awarding the prize described in these Terms and Conditions (the "Prize") to eligible participants.
2. Participation in this Campaign is free of charge. No purchase is necessary to participate, except, where applicable, the purchase of the services that are the object of the promotion.
Participants:
1. Any natural person, resident in the territory targeted by the Campaign, over 18 years of age or the age of majority in accordance with their country of residence in case it is higher, may participate.
2. Employees, executives and directors of LaLiga, its direct collaborators, such as agencies involved in the execution of the Campaign, and first-degree relatives of the aforementioned groups are not eligible to participate or win a Prize.
3. We may verify your identity, age and compliance with the conditions set out in these Terms and Conditions by means of official documents (ID, passport, etc.), at any time, including before and during the Prize delivery.
4. We may also check compliance with the terms of use of the social media or platforms through which you participate in the Campaign (where applicable). If you breach the terms of use of the social networks or platforms - or provide false identity data or information - you will be immediately disqualified and will be obliged to return the Prize if it has already been awarded to you.
5. Erroneous or incomplete submissions, or submissions which have taken place outside the participation period or which do not comply with the requirements of these Terms and Conditions, will not be valid.
6. You agree not to implement any method of participation in breach of these Terms and Conditions. We reserve the right to disqualify, at our sole discretion, any entry that (i) manipulates or attempts to manipulate the Campaign; (ii) violates these Terms and Conditions; (iii) abuses, threatens or harasses any other participant or third party and/or (iv) has been generated by automated systems, scripts or any other type of fraudulent use. LaLiga also reserves the right to take legal action against those individuals who carry out any type of act that could be considered manipulation of the Campaign.
Publication of content by participants:
1. In the event that your participation requires the publication of comments, photographs, videos or other types of content, your participation must comply with the following requirements: (i) be related to the subject matter of the Campaign; (ii) be original and not infringe third party rights; (iii) do not show content that could be considered offensive or defamatory; (iv) do not include brands or make reference to products or services of companies other than LaLiga, its clubs or sponsors; (v) be suitable for all audiences and not infringe the law, morality or public order, in particular it may not be sexually explicit or ordinary; (vi) not include or reveal personal data such as telephone numbers or addresses and (vii) do not include or evoke the image, likeness or name of other people without their authorisation. LaLiga is not responsible in the event of non-compliance with these requirements by participants and reserves the right not to publish or to remove comments or content that violate these conditions.
Prize:
1. The Prize will be awarded to the winner on a personal basis and may not be transferred or assigned to third parties, whether free of charge or at cost.
2. The Prize cannot be exchanged for another prize or for its cash value. The winner may renounce the Prize, but under no circumstances will the winner receive any compensation or indemnification.
3. We reserve the right to substitute the Prize for another of similar value if, for reasons beyond our control, the Prize is not available during the promotional period.
Notification to the winner and award of the Prize:
1. We may contact the winner to inform them of their status as a winner, confirm that they comply with the conditions of participation and request the necessary information/documentation to deliver the Prize. The winner must accept the Prize and send all the required documentation/information within a maximum period of two (2) working days (unless another period is indicated in the communication received), to the address provided by us. LaLiga assumes no liability whatsoever to any person who has not responded within the deadline.
2. In order to obtain the Prize, we may ask the winner to sign a letter of acceptance of the Prize.
3. The prize will be delivered to the winner, either by us or by a third party partner, no later than sixty (60) days after the winner has been informed of his/her status as a winner and has provided all the information necessary for delivery.
4. Once the Prize has been sent, to the maximum extent permitted by the applicable regulations, we are not responsible for any delay in delivery for reasons beyond our control and we shall not be in any way responsible for the possible loss or deterioration of the Prize, nor for the malfunction, if any, of the courier or delivery service.
5. If a winning participant waives his right to the Prize obtained, does not comply with the Terms and Conditions, does not provide the documentation or information requested or cannot be contacted, we may automatically reject his/her participation, without the need to notify him/her, and we may declare the Prize as “not awarded”. Alternatively we may decide to select an alternative winner following the same selection process and proceed to contact this alternative winner following the same communication procedure described above, and so on until the number of alternative participants is exhausted. If neither the winners nor the alternative winners comply with the Terms and Conditions, we reserve the right to declare the Prize as “not awarded”.
6. The name or profile name of the final winner will be published in the channels where the Campaign is managed or communicated.
Image rights and intellectual property:
1. Participants grant LaLiga a free, exclusive licence for all exploitation rights - including, by way of example, the rights of reproduction, distribution, public communication and transformation - that may correspond to them over the contents that, where appropriate, are submitted to participate in the Campaign, as well as over the rights to their image - including their name and nickname -, so that LaLiga can communicate their participation in the Campaign in any modality, format and/or media known or that may be known in the future (including, but not limited to, audiovisual, printed, sound and/or digital media, digital repositories, social networks, computer applications and/or databases). Likewise, the winners will collaborate in the promotional activities in relation to the Campaign and authorise the recording and use of their image, name and voice during the enjoyment of the Prize in any commercial operation.
2. This licence is granted on a worldwide territorial scope, for the maximum term of protection of the rights in accordance with the applicable law and with the right of assignment to third parties (in whole or in part, exclusively or not, free of charge or for a fee), without the right to any compensation or remuneration from LaLiga.
3. We shall not be liable for any breach of any rule or any infringement of third party rights by participants during their participation in the Campaign, and participants assume the obligation to hold LaLiga harmless in such case.
4. In the event that your participation consists of an image or video, in which identifiable third parties appear, you must be able to prove that you have their prior express consent for us to process their image so that we can exploit it in accordance with the licence described above. In addition, in cases where minors are involved, you must provide written authorisation from their parents or legal guardians. Any person who accompanies the winner during the enjoyment of the Prize shall also authorize the use of his/her image under the terms described herein.
Tax obligations:
1. The prizes are subject to the tax legislation in force, and the winner, in the event of acceptance of the Prize, must assume the tax obligations that correspond to him/her in relation to obtaining the Prize.
2. In the event that the winner is a resident in Spain and the value of the Prize awarded for withholding purposes exceeds the amount of three hundred euros (€300), LaLiga will be responsible for the payment of the corresponding payment on account in accordance with the rates in force on the date of accrual of the operation. The payment on account will not be passed on to the winners and will be assumed by LaLiga, which means that this payment will represent a greater value of the prize in kind received by the winners.
3. In the event that the winner is not resident in Spain, the winner's place of tax residence will have to be taken into account in order to determine the tax treatment of the Prize, in accordance with the applicable tax legislation in force. For these purposes, and if applicable, the winner must provide the certificate of tax residence for the purposes of the Agreement to avoid double taxation signed between Spain and the winner's country of residence.
4. Likewise, and where applicable, LaLiga will send the winner, in accordance with the regulations set out above, the corresponding certificate of withholdings and payments on account.

Processing of personal data:

The purpose of this clause on personal data protection (the "Policy") is to regulate the personal data processing activities carried out by LaLiga Group International, S.L. (hereinafter, "LaLiga") through the Campaign.

Who is responsible for the processing of your personal data?

Your personal data will be processed by LaLiga, with CIF B-05421805 and address at Calle Torrelaguna 60, 28043, Madrid.

Where do we get your personal data from?

LaLiga will process the data that you have provided us directly with your participation, following your personal account (user name in the corresponding social network), as well as the additional data that we will ask you for if you are the winner (name, surname, ID number, telephone number and postal address).

For what purposes do we process your personal data?

Main purposes:

Participation in the Campaign through the social network: We inform you that the personal data you provide through your participation (user name) will be processed by LaLiga for the purposes of facilitating, managing, maintaining and controlling your participation in the Campaign. Likewise, in the event of being chosen as the winner, we will contact you to ask you for additional information (name, surname, ID number, telephone number and postal address) in order to send you the prize.

The legal basis for the aforementioned purposes is the execution of the Terms and Conditions of the Campaign in which you participate by virtue of the provisions of article 6.1. b) of the European Data Protection Regulation. In this regard, we inform you that the data identified as compulsory are necessary to manage your participation in the Campaign. If you do not provide them, we will not be able to apply the measures requested by you.

How long will we keep your personal data?

The personal data we process will be kept for as long as the purposes for which they were collected or you do not exercise your rights of erasure, objection or restriction of processing.

Likewise, we inform you that once the purposes for which your data were collected have been fulfilled or once the aforementioned rights have been exercised, LaLiga will keep your personal data duly blocked for the period of time necessary to meet any liabilities of any kind that may arise. Said personal data will be deleted when the indicated period expires.

To which recipients will your personal data be communicated?

Your personal data will not be disclosed to third parties. However, LaLiga may disclose personal data and any other user information when required to do so by public authorities in the exercise of the functions legitimately attributed to them and in accordance with the applicable provisions.

What are your rights when you provide us with your personal data?

We inform you that, at any time, you can exercise your rights of access, rectification, opposition, deletion, portability and limitation of processing before LaLiga:

What are your rights as a user?

Right of access: you have the right to obtain confirmation as to whether LaLiga processes your personal data, as well as the right to access your personal data.
Right of rectification: you may request the modification or rectification of inaccurate personal data.
Right of erasure: you may request the erasure of your personal data.
Right to restrict processing: In certain circumstances, you may request that we restrict the processing of your data, in which case it will only be kept for the purpose of pursuing or defending claims.
Right of opposition: you may oppose the processing of your data for the purpose you specify. LaLiga will cease processing the data, except for compelling legitimate reasons, or the exercise or defence of possible claims.
Right of portability: if permitted, you may exercise the right to the portability of your data, in a structured, commonly used and machine-readable format, and to transmit it to another data controller.

How do I exercise my rights?

By sending an email to lopd@laliga.es. The exercise of your rights will be completely free of charge.

Finally, if you consider that you have not obtained satisfaction in the exercise of your rights or that the processing of your personal data by LaLiga has not been in accordance with data protection regulations, you may contact LaLiga's Data Protection Office at the email address dpo@laliga.es or file a complaint with the Spanish Data Protection Agency through its website www.agpd.es.

Responsibility:
1. Without limiting the rights of participants as consumers: (i) Participants exonerate us, and our collaborators or subcontractors from any type of liability for damages of any nature in relation to the Campaign and during the enjoyment of the Prize and within the limits established in the applicable regulations. (ii) LaLiga is not responsible for possible losses, dmages, delays or any other circumstance attributable to third parties that may affect electronic deliveries or communication of the Campaign.
2. LaLiga shall not be liable in the event of cancellation of the Campaign or impossibility of enjoying the Prize in the event of force majeure or unforeseeable circumstances, or for reasons that are not attributable to it or that are beyond the control of LaLiga (for example, in the case of prizes consisting of travel, flight or event cancellations, lack of valid personal travel documentation, etc.).
3. The participant acknowledges that the Campaign may be promoted through LaLiga's social media profiles (Facebook, Twitter, Instagram, TikTok, Twitch, etc.). However, the Campaign is not sponsored, endorsed or administered by the social media platforms. The user dissociates himself/herself completely from the social media platforms and is aware that by participating in the Campaign he/she is providing his/her personal information and data to LaLiga.
4. LaLiga disclaims any liability in relation to any opinions or statements made by third parties and/or media (without any intervention by LaLiga) in relation to the participants and/or winners of the Campaign.
Modifications:
1. We have the right to extend, postpone, modify or suspend the Campaign if there are reasons beyond our control or reasons not attributable to us that justify it, trying as far as possible that such changes do not adversely affect the participants. We will inform you of this circumstance and of the changes or new dates as soon as possible, without the participants having any right to receive or claim any compensation whatsoever.
2. LaLiga is empowered to, at its discretion, resolve any contingency not foreseen in the Terms and Conditions, based on the spirit and purpose of the same and we may adopt the necessary decisions for the resolution of incidents or unforeseen events that arise in the development of the Campaign as long as these do not unduly prejudice the participants and are fair.
Applicable law and jurisdiction:
1. The Campaign is governed in accordance with the provisions of Spanish law.
2. In those cases in which the regulations foresee the possibility of the parties submitting to a jurisdiction, LaLiga and the participant in the Campaign, expressly waiving any other jurisdiction that may correspond to them, accept to submit any controversies and/or disputes that arise or are related to the Campaign and these Terms and Conditions to the courts of the city of Madrid.
3. Nothing in these Terms and Conditions shall exclude, limit or restrict the rights of the participant under any applicable mandatory consumer law.
4. LaLiga reserves the right to exclude from the Campaign any participants who have been declared winner when the legislation of the winner's country of residence establishes limitations that are incompatible with obtaining the Prize.

Terms and Conditions:
1. These Terms and Conditions will be accessible through the media in which we communicate the Campaign and may be consulted and downloaded by participants at the link indicated in the Specific Conditions throughout the Campaign period. LaLiga will also keep a copy of the text and will make it available to you on request.
2. In case of conflict between the Particular Conditions and the General Conditions, the Particular Conditions shall prevail.
3. All clauses of the Terms and Conditions must be interpreted autonomously and independently. If one of them is declared null and void by a final court ruling, this will not affect the others and we will replace it with another one that will have the same effect.
